SMS marketing consent and compliance framework.

How consent is collected, verified and honored for SMS campaigns sent on behalf of Heng Dynamics client businesses — built to the TCPA, the CTIA Messaging Principles and Best Practices, and wireless carrier requirements.

Service status

SMS is a forthcoming capability. Heng Dynamics’ current services are email-based. This page documents the standards that will govern SMS campaigns ahead of their launch. It does not describe an active service, and no SMS traffic is being sent at this time.

Consent collection

Heng Dynamics LLC is a customer-reactivation service. Messages are sent on behalf of client businesses to those businesses’ own existing customers. Heng Dynamics does not build, purchase or supply contact lists, and does not message anyone with whom the client has no prior relationship.

Every SMS recipient will be an existing customer of a client business who has given prior express written consent through one or more of the verified methods below.

1. Website opt-in forms

Client websites collect consent through contact and booking forms carrying an explicit, unchecked SMS opt-in checkbox, separate from any other consent, and never a condition of purchase.

2. Paper and digital intake forms

Service-based client businesses collect signed consent on customer intake forms carrying SMS consent language, the required disclosures, and signature and date fields.

3. Client attestation

Before any SMS campaign is dispatched, the client business must execute the Heng Dynamics SMS Consent Attestation, confirming:

Every message identifies the sending business, carries opt-out instructions, and goes only to contacts with verified prior consent.

Message content standards

No campaign will carry content in a carrier-restricted category. Specifically excluded: cannabis, CBD, tobacco and vaping, firearms, prescription pharmaceuticals, gambling, high-risk financial services including short-term and payday lending, debt collection and credit repair, and any lead-generation traffic sold or transferred to a third party.

Messages contain no public URL shorteners. Links resolve to the client’s own domain or to a branded sending domain associated with the campaign.
